Terms & Conditions (“Terms”) govern your access to and use of the DermClick website, services, subscription programs, and related offerings (“Services”), operated by DermClick LLC, a Delaware limited liability company (“DermClick,” “we,” “us,” or “our”).
By accessing or using DermClick, you agree to these Terms.
If you do not agree, do not use the Services.
1. COMPANY ROLE & RELATIONSHIP TO MEDICAL SERVICES
DermClick LLC does not provide medical care.
All medical consultations, diagnoses, treatment plans, and prescription decisions are provided exclusively by independent, licensed clinicians, the "Provider", sourced by and utilizing technology by Dermifi Solutions, LLC (“Dermifi”), MSO.
DermClick operates as a technology, administrative, and coordination platform only.
• DermClick does not practice medicine.
• DermClick is not a medical group.
• DermClick does not employ or supervise the medical providers.
• All medical decisions are made solely by the Provider
Your agreement with the Provider and Dermifi is separate and will include your Telehealth Consent.
2. ELIGIBILITY
To use DermClick:
• You must be 18 years or older, OR
• A parent/legal guardian must create and manage the account for a minor (where legally allowed).
By using the Services, you represent that the information you provide is accurate and truthful.
3. ACCOUNT REGISTRATION
Users must create an account to access consultations, subscriptions, orders, and medical evaluations.
You agree to:
• Provide accurate information
• Maintain confidentiality of your login details
• Notify us immediately of any unauthorized access
We may suspend or terminate accounts for:
•.Fraud
• Chargebacks
• Abuse of Services
• Submitting inappropriate or unlawful content
• Violations of these Terms
4. DESCRIPTION OF SERVICES
DermClick provides:
• Access to online dermatology intake forms
• Asynchronous and synchronous telehealth connections to the Provider
• Personalized prescription skincare
• Monthly subscription shipments of prescription products
• Customer support and digital communications
All prescription approvals, treatment plans, and follow-up decisions are made solely by the Provider.
5. PAYMENT TERMS, SUBSCRIPTION BILLING, & AUTO-RENEWAL
You understand and agree that you are responsible for all fees associated with accessing healthcare and pharmacy services through DermClick. These fees include the monthly subscription charge for use of the Services, consultation fees for visits with a Provider (whether asynchronous or synchronous), and any costs related to prescription fulfillment, including medication charges and applicable shipping and handling. All fees will be disclosed at checkout.
Most DermClick prescription treatments are provided through monthly auto-renewing subscriptions.
By purchasing, you acknowledge:
• Your subscription auto-renews each month
• You authorize DermClick to charge your payment method monthly
• Prices are disclosed at checkout and in your account
• No prorated refunds are provided
You may pause or cancel anytime by:
• Logging into your DermClick account under “Subscriptions,”;
• Emailing [email protected]; or
• Completing this pre-formatted email
Cancellations apply to future charges only.
6. PRICING & PAYMENT
DermClick accepts major credit cards, PayPal, and other standard payment methods.
You acknowledge and agree that:
• DermClick may update pricing with notice
• Your payment method must remain valid and up-to-date
• Failed payments may suspend service or shipment
• Dermatology consultation fees (if any) are non-refundable
Chargebacks may result in account termination.
7. REFUNDS, RETURNS & CANCELLATIONS
7.1 Prescription Products Cannot Be Returned
Due to federal regulations, prescription skincare products cannot be returned or resold once they leave the pharmacy.
7.2 Refund Window (Before Shipment)
If your order has not yet shipped, we allow cancellation and refund within 24 hours of purchase.
7.3 No Returns After Shipment
Once shipped, all sales are final.
7.4 Damaged or Incorrect Orders
If your package arrives damaged or incorrect, email [email protected] within 7 days, and we will resolve the issue.
8. SHIPPING & DELIVERY
• Shipping is included in subscription prices
• Orders typically ship in 3–4 business days after medical approval
• Delivery times may vary due to carrier delays
• We ship to addresses within the United States, including PO Boxes and HI/AK as carrier policies allow
Risk of loss transfers upon delivery to the carrier.
9. USER CONTENT (REVIEWS, TESTIMONIALS, PHOTOS)
By submitting reviews, testimonials, photos, or other content, you grant DermClick a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and distribute that content for marketing or promotional purposes.
You must submit only content you have the right to share.
10. PROHIBITED USES
You may not use DermClick to:
• Engage in fraudulent activity
• Impersonate others
• Submit false health information
• Upload unlawful, defamatory, obscene, or harmful content
• Attempt to reverse-engineer or disrupt the platform
We may suspend or terminate accounts violating these rules.
11. NO WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DERMCLICK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, AND SECURITY. WE DO NOT GUARANTEE THAT THE WEBSITE OR SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED. DERMCLICK DOES NOT CONTROL NOR GUARANTEE QUALITY, OUTCOMES, TIMELINESS, OR LEGAL COMPLAINT OF PROVIDER SERVICES OR PHARMACY PRODUCTS, AND DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO PROVIDER-PATIENT INTERACTIONS, CLINICAL DECISIONS, PRESCRIPTIONS, OR PHARMACY COMPOUNDING AND FULFILMENT.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DERMCLICK OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DERMCLICK’S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO DERMCLICK IN THE PAST 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; IN THOSE STATES, THE ABOVE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
13. TELEHEALTH
Your use of DermClick may involve asynchronous or synchronous telemedicine.
You must read and electronically accept the Telehealth Consent with Dermifi and the Provider.
Telehealth limitations include (but are not limited to):
• No physical exam
• Potential diagnostic limitations
• Risk of delayed communications
• Need for in-person follow-up as determined by the Provider
You agree that emergencies must be directed to 911 or local urgent care.
14. COMMUNICATION CONSENT (EMAIL, SMS, ELECTRONIC)
By using DermClick, you consent to communications including:
• SMS
• Email
• Portal messages
• Automated notifications
Standard carrier messaging rates apply.
You may opt out of marketing SMS, but transactional messages may still be sent.
15. PRIVACY
Your use of the Services is governed by our Privacy Policy.
By using DermClick, you consent to:
• Data collection
• Use of tracking technologies (e.g., GA4, Facebook Pixel)
• Storage of health-related information
• Data retention for at least 6 years
• Ability to request data deletion (with exceptions for medical record retention)

16. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
Any disputes shall be resolved exclusively in:
• San Diego County, California.
17. CHANGES TO TERMS
We may update these Terms at any time.
Changes will be posted with a new “Last Updated” date.
Continued use of the Services constitutes acceptance of updated Terms.

19. ENTIRE AGREEMENT
These Terms constitute the full agreement between you and DermClick regarding use of the Services. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any provision shall not be a waiver of that provision.
